These terms and conditions contain the legal and technical rules for the provision of the notary public services supplied by Notary Public Center. The jurisdiction and scope applicable to the notary public services shall be that of the State of Florida, and the applicable law shall likewise be that of the State of Florida.
TERMS OF USE OF THE DIGITAL NOTARY
The digital notary is a platform that allows the following activities:
- It can be accessed from any device connected to an internet service that meets the following requirements:
- Browsers that allow access to the internet.
- Mobile devices that allow access to the internet.
- The minimum bandwidth required to browse, start and complete the necessary procedures.
- It allows the registration and/or enrollment of the user with personal data, accepting the processing of that data, in order to access notary public services through electronic means.
- It allows the authentication of the user of the notary public services by means of electronic signatures, in order to access notary public services through electronic means.
- It allows the identification of the user by providing the last 4 digits of the Social Security Number, by verification video call or by biometrics.
- A user who has a Social Security Number must provide the following information: last 4 digits of the Social Security Number, date of birth in month/day/year format, type of identity document, full name, first surname and email address.
- A user who does not have a Social Security Number must provide the following information: type of identity document, identity document number, date of issue of the identity document, full names, full surnames and email address. The user’s identity will be verified by a video call on the Zoom platform, of which an audio and video record will be kept.
- A user who is identified through the biometric service must provide the following information: the user’s passport, full names, first surname and email address.
- The identification of the user may be validated through the verification of identity documents and a video call as follows:
- Users with a Social Security Number: they must register the last 4 digits of the Social Security Number and their date of birth in month/day/year format, and satisfactorily answer the identification questions associated with their Social Security Number.
- Users without a Social Security Number: a verification video call will be held on the Zoom platform, during which the user must provide their full names and surnames, the date of issue and the number of their identity document, show the identity document to the camera for at least 10 seconds and acknowledge the document they wish to sign.
- Users verified by biometrics: an image of the passport is captured through the camera of the computer or laptop; the user must stand in front of the device’s camera and move their face so that the platform can perform the biometric verification.
- It allows the acceptance of terms and conditions as evidence of the contractual relationship for the provision of a notary public service through electronic means.
- Digital notarization allows the electronic recording of the notary’s digital signature, together with the time and date on which that signature was made, and does the same with the digital signature of the signer of the electronic document.
SERVICE FEES
The fees for the registration of digital signatures and electronic signature methods, as well as for the notary services provided through the notary, are those published for consultation in the online store of Notary Public Center.
REGULATORY COMPLIANCE
The digital notary service complies with the laws of the State of Florida and with the Hague Convention of 5 October 1961 ABOLISHING THE REQUIREMENT OF LEGALISATION FOR FOREIGN PUBLIC DOCUMENTS.
GUARANTEE OF INTEGRITY OF THE ELECTRONIC DOCUMENT
Digital notarization integrates the notary’s signatures in order to validate the digital signatures of the electronic documents for which users request any of the procedures permitted and provided by this notary. Those signatures are accompanied by a seal of authenticity generated automatically when the electronic signature is applied.
SCOPE OF THE SERVICE PROVIDED BY THE NOTARY
- Notarization (acknowledgment of document signers)
- Verification of the signer’s identity.
- Acknowledgment of the signer’s signature.
- Apostille of documents
- Electronic apostille, provided it is accepted in the destination country.
- Paper apostille.
- Shipping of apostilled documents.
- Marriage
- Performance of the ceremony.
- Drafting and apostille of proof of life / survival certificates
- Drafting of the document.
- Identification of the signer.
- Apostille of the document.
- Shipping of the apostilled document.
RESTRICTION FOR ILLEGAL USE OF THE NOTARY
Any illegal use of the services provided by the notary entails the suspension or revocation of the services supplied.
For this purpose, Notary Public Center may consult and/or verify public or private information in public or private media, or information it comes to know by any lawful means, in which the user or signer is cited, mentioned or linked to any illegal conduct.
In order to mitigate the reputational risks of Notary Public Center, the information that can be gathered will be sufficient to proceed with the suspension or revocation of the service.
ACCESS TO THE DIGITAL NOTARY
To access the electronic signature services supplied by Notary Public Center, the user must complete the following steps:
- Accept the terms and conditions.
- Provide the information required to perform the service.
- Accept and sign electronically as instructed by the notary.
Notary Public Center does not guarantee the electronic signing process when the user does not satisfactorily complete the process described and detailed here.
ELECTRONIC SIGNATURE USE AGREEMENT
By accepting these terms and conditions, the user agrees that in all documents signed electronically, the mechanisms or techniques of personal identification or electronic authentication, as the case may be, are presumed to meet the requirements of an electronic signature.
PROOF OF THE NOTARIAL DIGITAL SIGNATURE
For legal purposes, proof of the digital signature will be embedded in the document itself and may be verified through the transaction report contained in the platform, which makes it possible to determine whether the document was digitally signed.
LIABILITY FOR FALSE OR FRAUDULENT INFORMATION
The user shall be liable to Notary Public Center and to relying third parties for the provision of false information, whether in the electronic documents or in the registration for the services provided by the notary, that causes or may cause economic, financial or reputational harm to the entities and unidentified persons described herein.
RELEASE FROM LIABILITY FOR FRAUDULENT OR ILLEGAL ACTS
The user releases Notary Public Center from all liability for fraudulent, unlawful or illegal acts carried out using the Digital Notary services.
Any use of the Digital Notary outside lawful uses, outside the provisions of these terms and conditions or of the comprehensive commercial agreement signed with Notary Public Center, shall be the sole responsibility of the user and therefore releases Notary Public Center from any summons by administrative or judicial authorities to answer in investigations, judicial proceedings or similar matters for the unlawful or unagreed uses that the user has made of the notary and its services.
The same applies to any unauthorized reference to the trademarks of Notary Public Center that may cause harm or increase reputational, economic, financial or similar risk.
AUTHORIZED USE OF THE TRADEMARKS, LOGOS, SLOGANS AND SEALS OF NOTARY PUBLIC CENTER
The user may refer to Notary Public Center within the limits of the law and under the following terms:
- To refer to Notary Public Center as the provider of notary public services.
- To refer to Notary Public Center respectfully, without harming its honor and good name on social media, before relying third parties or in any other form of public or private mention.
For the authorized use of other trademarks of Notary Public Center, the user must obtain prior authorization, or otherwise incur legal liability for their unauthorized use. Notary Public Center reserves the right to take all legal actions it deems necessary and/or appropriate to restore its rights.
CONFIDENTIALITY OF USER INFORMATION
User information is confidential and will be processed in accordance with these terms and conditions.
CONFIDENTIALITY AND KNOW-HOW OF NOTARY PUBLIC CENTER’S INFORMATION
The information available to the public is the property of Notary Public Center, as is the means through which users use the notary and its related services.
Accordingly, that information is not to be delivered to users or relying third parties, except for the information available to the public, which may be supplied by Notary Public Center or at the request of the user, a relying third party or any other person who requests it respectfully.
Before delivering the requested information, Notary Public Center may determine whether it is feasible to supply it and validate the purpose for which it is required.
Depending on its assessment, Notary Public Center may, at its sole discretion, supply the requested information or limit its delivery in whole or in part, and may define the uses that may be made of the information supplied.
Any total or partial reproduction must have the prior authorization of Notary Public Center, and its use must not harm the honor and good name of Notary Public Center or its trademarks, slogans, trade names, industrial property or know-how. Such reproduction must comply with the copyright rules applicable in the State of Florida and the international conventions or rules applicable to the matter.
LIABILITY FOR EACH NOTARY SERVICE
Notary Public Center will act in accordance with the information, the documentation and the service request submitted by the user.
The user is responsible for the content, clarity and scope of the documents provided and of the request made.
REFUNDS
All refund requests must be handled directly by Notary Public Center.
